Order of Optical glasses with Home Trial Service

The company offers the possibility to try out glass frames for free (hereinafter referred to as "Home Trial Service"). This service includes the possibility of trying out eyeglass frames without the glasses or corrective lenses, and is offered to customers with residing, billing and contact address in the Czech Republic. An order of goods on trial does not engender the obligation to purchase for the customer.

To order this service, just as in the case of purchase, those interested in the service (the "Customer") shall fill out an order form on the Web Interface. The Customer can choose 1 - 3 pairs of eyeglass frames according to the current offered selection. The Customer is obliged to pay the company for the provided service a flat rate compensation of costs in the amount of CZK 190. The payment of the flat rate costs must be paid by a payment card through the PayU payment portal.

After filling out the order form, the total price of the frames the Customer ordered will be displayed on the Web Interface. The Order will then be confirmed by the Seller by an email message. After the confirmation of the Order and after payment in the amount of CZK 190 to the company's account, the eyeglass frames (hereinafter referred to as "Consignment") will be sent to the Buyer's address.

Then, within 3 working days after the Order form is sent to the company and after the amount of CZK 190 is paid, the Consignment will be sent to the address of the Customer. The Customer is entitled to use the eyeglass frames in accordance with the agreed purpose, i.e. to try them out, and is obligated to protect the eyeglass frames against damage or loss and subsequently return them to the company.

The Customer undertakes to send back the eyeglass frames no later than 4 working days after receiving the Consignment, to the company's headquarters address at Easy Eye Wear s.r.o., Jugoslávská 659/11, Prague 2, 120 00. The deadline period begins to run the day of the receipt of the Consignment. If the Customer chooses from among the tried out eyeglass frames, they can order them including glasses and corrective lenses (hereinafter referred to as "Eyeglasses") and pay the Purchase Price through the Web Interface (see Ordering of Goods). If the Customer enters into the Order of goods the code they received in the confirmation email of the order of goods on trial, the amount of CZK 190 will be deducted from the Purchase Price of the eyeglasses. The ordered goods will then be sent with the original case and cleaning cloth.

If the Customer does not return the Consignment, they are obligated to pay the company, within the same deadline period, the total price that was given to them (by being displayed on the Web Interface) before the Order of goods on trial was sent. If they fail to do this, so-called unjust enrichment arises for the Customer, in the amount of this total displayed price of the Consignment (hereinafter referred to as "Unjust Enrichment"). Unjust Enrichment is payable on the day following the expiration of the 4-day period for returning the consignment. From this date, the Customer is obligated also to pay the company statutory interest on the late payment of the owed amount.

If the Customer returns the Consignment incomplete, damaged or destroyed, they must pay the company the damages it incurred. The company shall notify them at their address of the amount of damages incurred no later than 5 days after receiving the returned Consignment.

The Buyer is obligated to check the consignment upon receiving it (number of packages, intactness of the packaging, -- box) to determine whether the contents were not damaged in transit. The Buyer is entitled to refuse acceptance of goods which are not in conformity with the Purchase Contract because, for example, the shipment is incomplete or damaged. If the Buyer takes over such a damaged package from the shipper, it is necessary to describe the damage in the handover report. An incomplete or damaged shipment must be reported immediately by e-mail to the address info@easyoptic.cz and a damage report shall be written up with the carrier and sent without undue delay by e-mail or mail to the Seller. Further complaints regarding incomplete or external damage to the shipment does not deprive the Buyer of the right to claim a return, but it does gives the Seller the opportunity to demonstrate that there is no non-compliance with the Purchase Contract.

By signing the delivery note, the Buyer confirms that the shipment of the goods satisfies all conditions and prerequisites, and any later complaint concerning violation of the integrity of the shipment packaging will not be taken into consideration.
