Usage terms and conditions of Easy Optic

of Easy Eye Wear s. r. o., IČ 24298085, DIČ CZ24298085 with registered office at Jugoslávská 659/11, 120 00 Prague 2, registered at the Municipal Court in Prague, in section C, file 194222, for the sale of optical and sunglasses, prescription lenses and contact lenses to end users via eshop located at www.easyoptic.cz and in the optical shop Easy Optic, Jugoslávská 320/21, Prague 2, Vinohrady.

Introductory Provisions

These Terms and Conditions of Easy Eye Wear s. r. o., Business ID 24298085, Tax ID CZ24298085, based at Jugoslávská 659/11, 120 00 Prague 2, registered at the Municipal Court in Prague, Section C, File 194222 (hereinafter referred to as "Seller") regulate the mutual rights and obligations of the parties arising in connection with or pursuant to the purchase contract (hereinafter referred as "Purchase Contract") concluded between the Seller and another individual or legal entity (hereinafter referred to as "Buyer") through the internet store of the Seller. The internet Store is operated by the Seller at the website http://www.easyoptic.cz through a web interface.

The Terms and Conditions also regulate the rights and obligations of the parties in the use of the Seller's website located at http://www.easyoptic.cz and other related legal relations.

These terms and conditions apply similarly when ordering through another means of remote communication (e.g. email) and with certain changes even when ordering in person at the store or outside the buyer's sales premises (filling in the order-form or direct purchase on the spot), especially by describing the order, filling in the order form, unless otherwise specified.

Provisions different from those provided in the Terms and Conditions may be agreed in the Purchase Contract. Different covenants in the Purchase Contract shall prevail over the provisions of the Terms and Conditions.

The provisions of the Terms and Conditions are an integral part of the Purchase Contract. The Purchase Contract and the Terms and Conditions are executed in English.

The Seller may change or amend the wording of the Terms and Conditions. This provision shall not affect the rights and obligations established during the effectiveness of the previous version of these Terms and Conditions.

Legal relations between the seller and the buyer not expressly regulated by these terms and conditions are governed by Act No. 89/2012 Coll., Civil Code, as amended, and Act No. 634/1992 Coll., on consumer protection, as amended.

User Account

On the basis of the Buyer's registration, made through the website www.easyoptic.cz (hereinafter referred to as the "Web Interface"), the Buyer may access their user interface. The Buyer may order goods from their user interface (hereinafter referred to as the "User Account"). The Buyer may also order goods directly from the web interface without registration.

When registering on the website and when ordering goods, the Buyer is obliged to provide all data correctly and truly. The Buyer is obliged to update the data he (or she) provided in the User Account any time it changes. Data provided by the Buyer in the User Account and upon ordering goods will be considered by the Seller as correct.

Access to the User Account is secured by a user name and a password. The Buyer is obliged to maintain in confidence all information necessary for accessing their User Account and acknowledges that the Seller assumes no responsibility for the violation of this obligation by the Buyer.

The Buyer is not entitled to allow third parties to use the User Account.

The Seller may cancel the User Account, in particular when the Buyer has not used their User Account for more than 12 months, or if the Buyer violates their obligations resulting from the Purchase Contract (including the Terms and Conditions).

The Buyer acknowledges that the User Account may not be available continuously, in particular with regard to the necessary maintenance of the Seller's hardware and software or necessary maintenance of hardware and software of third parties.

Prices of Goods

The web interface contains a list of goods offered for sale by the Seller, including the prices of the individual goods offered (hereinafter referred to as the "Purchase Price"). Purchase prices are given inclusive of the value-added tax and include costs connected with the packing of the goods. The range of goods for sale and prices of such goods remain valid for the period during which they are displayed on the store's web interface. This provision does not limit the Seller's option to enter into the Purchase Contract under individually agreed conditions.

The store's web interface also includes information about costs related to the delivery of goods. The information on the costs associated with the delivery of the goods listed on the web interface of the store is valid only in cases where the goods are delivered within the territory of the Czech Republic.

The Seller reserves the right to change prices at any time. The Buyer receives the goods for the price valid in the web interface at the time of ordering. This price will be included in the order and the email confirming the acceptance of the goods order. 

Special prices are valid while supplies last with specification of the number of discounted goods or for a specified period of time.

Ordering of Goods

To order the goods, the Buyer shall complete the order form available on the store's web interface. The Buyer fills in all the data specified in the order as mandatory.

The order form includes in particular information about the following:

  • The goods ordered (the Buyer "puts" the goods ordered in the electronic shopping basket of the store's web interface),
  • The price of the goods
  • The price for delivery of the goods
  • Method of payment
  • Method of delivery of the goods ordered

(hereinafter referred to as the "Order").

Orders can be made in the following ways:

• Through the web interface
• Personally in the optical shop Easy Optic, Jugoslávská 21, Praha 2, 120 00

The order is sent by the Buyer to the Seller. Immediately after receiving the Order, the Seller shall confirm such receipt to the Buyer by electronic mail to the Buyer's electronic mail address provided in the user interface or in the Order (hereinafter referred to as the "Buyer's Electronic Address"). In case the order is sent and at the same time the purchase price of the goods is paid immediately through the web interface, the Seller shall send the Buyer an issued invoice along with the confirmation.

By sending the order, the Buyer declares that he (or she) is bindingly ordering the goods specified in the order, and confirms that he (or she) is acquainted with the Terms and Conditions, and that he (or she) agrees with them in the version in force and effective at the moment the order is sent.

A condition of the electronic order's being in force is filling in all the data and requirements prescribed by the form. The Seller is entitled, depending on the nature of the order (quantity of goods, amount of the purchase price, estimated transport costs), to ask the Buyer for additional confirmation of the order (e.g. in writing or by telephone).

The Seller reserves the right to refuse to process the order if the information given in the order is incomplete or inspires doubt about the actual intention of the Buyer to order the goods. In such a case, the Seller informs the Buyer and asks him to complete the data.

The Seller further reserves the right not to accept the Order in case an obvious misprint regarding the price, description or a picture of goods on the Seller´s website. The Seller informs the Buyer about non-acceptance of the Order via email on the address in the Order.

The Seller is not responsible for the selection and the quantity of goods chosen by the Buyer.

Purchase Contract

The Buyer's order is a proposal to conclude a Purchase Contract with the Seller. The contractual relationship between the Seller and the Buyer arises from the delivery of the confirmation of the order (acceptance), which the Seller sends to the Buyer by electronic mail to the electronic address of the Buyer. The Order and the confirmation of its receipt are considered to be delivered if the parties for whom they were intended can become acquainted with them.

From that moment, mutual rights and obligations arise between the Buyer and Seller, which are defined by the Purchase Contract and the Terms and Conditions that are an integral part of such a contract and are sent to the Buyer together with the Order confirmation. Through the Purchase Contract, the Seller agrees to deliver the goods specified in the Order to the Seller within the time limit set in the Terms and Conditions and to the place of delivery specified in the Order, and the Buyer agrees to accept these goods from the Seller or their chosen carrier and pay the purchase price of the goods to the Seller (if they have not already paid in advance through the web interface) and the price for the transport of the goods stipulated in the Order.

The Buyer agrees with using remote communication means when concluding purchase contracts. The costs incurred by the Buyer when using remote communication means in connection with entering into the Purchase Contract (costs of internet connection or telephone calls) shall be paid by the Buyer. The Seller imposes in connection herewith no additional fee to the Buyer.

The concluded contract is archived by the Seller for the purpose of its successful fulfilment and is not accessible to third parties.

Withdrawal from the Contract

In case the Purchase contract was concluded via remote communication means, i.e. not in the business premises of the Seller, the Buyer (who acted by purchase of the goods as the Consumer) has the right in to withdraw from the contract in the term of 14 days from the takeover of the goods.

If the Buyer decides to exercise this right, they must meet the following conditions:

a) The Buyer sends within the above-mentioned term (i.e.14 days from the goods delivery) the withdrawal from the contract preferably in the form of an email message with the following text:
"I have decided to withdraw from the contract dated DD.MM.YEAR, invoice number ………. and request the refund of the purchase price to the bank account number:………."
Date and signature. The Seller confirms the delivery of the withdrawal without undue delay.

b) The Buyer delivers the goods to the Seller's address within 14 days from the dispatch of the withdrawal from the contract to the Seller together with a copy of the withdrawal from the Purchase contract. The Buyer may also bring the goods in person to Easy Optic, Jugoslávská 320/21, Prague 2 120 00.

c) The Buyer must return the goods complete, unused, with complete documentation, undamaged, clean, in the original undamaged packing, with the same value as when they had received the goods. The Buyer acknowledges that if the returned goods are damaged, or worn, or if additional damages will be caused, the Seller is entitled to compensation from the Buyer for the damages they thus incurred. The Seller is entitled to set off the right to compensation for the incurred damage unilaterally against the Buyer's right to be refunded the Purchase Price.

In particular, the Buyer may not withdraw from the contract in this way, if it is a delivery of goods that

  1. was modified according to the Buyer's requirements or adapted to his personal needs,
  2. which is subject to rapid deterioration, or goods with a short consumption period, as well as goods which, due to their nature, have been irreversibly mixed with other goods after delivery, or
  3. which the Buyer removed from the sealed package and for reasons of health protection or hygiene reasons it is not appropriate to return the goods after the Buyer has broken them.

In case of withdrawal from the contract according to the Terms and Conditions, the Seller shall refund the purchase price (exclusive of the delivery costs of the goods) to the Buyer within 14 days after the withdrawal from the contract, not sooner before delivery of the returned goods or proof that the goods were sent back to the Seller. The return of the purchase price shall be a cashless transfer to the account specified by the Buyer.

If the order was paid through employee benefits, the Buyer will request the points to be returned to the account/card with benefits.

The Seller reserves the right not to accept goods sent by the Buyer to the Seller through the postal service "cash on delivery".

The costs related to the return of the goods shall be borne by the Buyer. The Buyer further accepts that the Seller is entitled to charge for actual and documented costs related to the return of the goods incurred to the Seller in connection with the goods return and deduct these costs from the returned purchase price. 

If a gift was provided to the Buyer together with the goods, the gift contract between the Seller and the buyer is concluded with the discontinuing condition that if the Buyer withdraws from the purchase contract, the gift contract regarding such a gift ceases to be effective and the Buyer is obliged to return the goods to the Seller together with gift given.

Payment Terms

The Buyer may pay the Seller for the Purchase Price of the goods and the price of delivery of the goods by following means:

  • payment card through the internet portal GoPay while ordering goods.
  • bank transfer through the internet portal GoPay while ordering goods.
  • cash on delivery
  • cash or payment card when picking up the goods in the optical shop Easy Optic

In the case of payment by credit card via GoPay, the purchase price is payable immediately via the web interface. In the case of a bank transfer, the Buyer's obligation to pay the purchase price is fulfilled when the relevant amount is credited to the seller's account. In the case of payment by cash on delivery, the purchase price is payable upon receipt of the goods from the carrier. In the case of the pick up of the goods at Easy Optic, the purchase price is payable upon the take over of the goods.

The Seller is a value-added tax payer. The tax document – invoice – shall be issued by the Seller to the Buyer after payment of the price of the goods and shall be sent in electronic form to the Buyer's Electronic Address. In the case of the pick up of the goods at Easy Optic, the invoice will be handed over to the buyer on the spot by the seller. In the case of the payment by cash on delivery, the invoice will be inserted into the delivery box.

The title to the goods shall pass to the Buyer at the moment the Purchase Price of the goods has been fully paid.

Terms of Delivery 

The Buyer has two options for receiving the goods; by personal pick up at Easy Optic or by collection of the goods from an employee of the shipping service.

Personal collection:

The goods can be collected by the Buyer or another person at the place of delivery or at Easy Optic, who must show a valid ID card or a valid passport. The order can be picked up at the Easy Optic studio within five working days from its confirmation. If the Buyer (or a person authorized by him) does not pick up the goods within the specified period, such failure to pick up is considered as a withdrawal from the contract. This does not apply if the Buyer does not have the right to withdraw from the contract according to these terms and conditions. In such a case, the Buyer will be repeatedly invited to pick up the goods and if he does not pick them up despite the additional invitation, the Seller will charge the buyer a storage fee of EUR 1,5 per day and is also entitled to withdraw from the contract. In the event of withdrawal, the Buyer is obliged to pay the Seller compensation for damage, which the Seller is entitled to set off against the Buyer's claim for a refund of the purchase price.

Delivery by a shipping service:

The Buyer can choose the PPL or Czech Post shipping service. According to the purchase contract, the Seller is obliged to deliver the goods to the place specified by the Buyer in the order. The Buyer is obliged to accept the goods upon delivery. If the Buyer does not take over the goods upon delivery, the Seller is entitled to demand a storage fee of EUR 0,2 per day and is also entitled to withdraw from the purchase contract.
The delivery period begins on the day the order is confirmed by the Seller. The seller delivers the goods within 3 working days at the latest in the case of an order for sunglasses or optical frames without prescription lenses. In the case of an order of eyeglasses with prescription lenses, the Seller delivers the goods no later than 10 working days from the confirmation of the order to the address specified by the Buyer in the order. The specified shipping time may be extended depending on seasonal fluctuations (e.g. Christmas) and warehouse occupancy. In the event of a change in the shipping date, the Buyer will be informed by the Seller in time.
Delivery of goods under these Terms and Conditions is considered the moment of delivery to the Buyer in accordance with the Purchase Contract.  Unreasonable refusal of takeover of the goods by the Buyer is not considered a failure of the Seller to fulfil the obligation of delivering the goods and the Seller is entitled to charge to the Buyer the costs for delivery and return of the goods.

The price of transport is determined by the current price list on the date of the Order on the web interface.

The Buyer is obligated to check the consignment upon receiving it (number of packages, intactness of the packaging, -- box) to determine whether the contents were not damaged in transit. The Buyer is entitled to refuse acceptance of goods which are not in conformity with the Purchase Contract because, for example, the shipment is incomplete or damaged. If the Buyer takes over such a damaged package from the shipper, it is necessary to describe the damage in the handover report. An incomplete or damaged shipment must be reported immediately by e-mail to the address info@easyoptic.cz and a damage report shall be written up with the carrier and sent without undue delay by e-mail or mail to the Seller. Further complaints regarding incomplete or external damage to the shipment does not deprive the Buyer of the right to claim a return, but it does gives the Seller the opportunity to demonstrate that there is no non-compliance with the Purchase Contract.

By signing the delivery note, the Buyer confirms that the shipment of the goods satisfies all conditions and prerequisites, and any later complaint concerning violation of the integrity of the shipment packaging will not be taken into consideration.

Warranty Terms

The rights and obligations of the contracting parties concerning the Seller's liability for defects, including the Seller's warranty liability, are governed by the applicable generally binding. 

The Seller is responsible to the Buyer for the fact that the goods correspond to the agreed description, type and quantity, as well as quality, functionality, compatibility, interoperability and other agreed characteristics, are suitable for the purpose for which the Buyer requires them and to which the Seller agreed, are delivered with the agreed accessories and instructions for use, including assembly or installation instructions.
If the goods have a defect, the Buyer can request its removal. According to his choice, the Buyer can demand the delivery of new goods without a defect or repair of the goods, unless the chosen method of removing the defect is impossible or disproportionately expensive compared to the other method of removing the defect.

If the defect in the goods represents a substantial breach of contract, if the defect appears repeatedly or if the Seller refuses to remove the defect, the Buyer has the right to a reasonable discount or withdrawal from the contract. The reasonable discount is determined as the difference between the value of the goods without defect and the defective goods received by the Buyer.

The Buyer will inform the Seller of the right he has chosen, when the defect is pointed out, or without undue delay after the defect is pointed out. The choice made cannot be changed by the Buyer without the consent of the Seller; this does not apply if the Buyer requested the repair of a defect that turns out to be irreparable. If the Seller does not remove the defects within a reasonable time after the defect is pointed out, or if he informs the Buyer that he will not remove the defects, the Buyer may demand a reasonable discount instead of removing the defect, or may withdraw from the contract.
The Buyer is responsible to the Seller for the reduction in the value of the goods that occurred as a result of handling the goods in a way other than what is necessary to find  the nature, properties and functionality of the goods.
The Buyer can exercise rights from product defects within 2 years of receipt. If a defect becomes apparent within 1 year of receipt, it is considered that the goods were already defective upon receipt, unless the nature of the goods or defects precludes this.
The claim does not apply to defects arising as a result of careless handling, wear and tear, mechanical damage or the use of the goods in contradiction to the maintenance instructions or the intended use of the goods.
The Buyer's rights from defective performance are exercised by the Buyer at the address of the Seller's optical shop Easy Optic. Transport to the place of application of the claim is paid by the Buyer. The Seller issues a confirmation of receipt of the claim to the Buyer. In the event of a justified complaint, the costs associated with the complaint will be refunded to the Buyer.

Ordering goods for a hometrial

The Seller offers the opportunity to try the optical frames free of charge (hereinafter referred to as the "home trial"). This service includes the possibility to try on optical frames without prescription lenses and is offered only in the area of the Czech Republic. By ordering hometrial, the interested party does not commit to purchase.
To order this service, just as in the case of a purchase, the person interested in this service (hereinafter referred to as the "interested party") fills out the order form in the web interface. The interested party can choose 1-3 pairs of optical frames according to the current offer. For the service provided, the interested party is obliged to pay the Seller a flat-rate reimbursement of costs in the amount of CZK 190. The flat-rate costs must be paid by credit card via the GoPay payment portal.

After filling out the order form, the total price of the optical frames ordered by the interested party will be displayed on the web interface. Subsequently, the order will be confirmed by the Seller by email. After confirmation of the order and payment of the amount of CZK 190 to the Seller's account, the optical frames (hereinafter referred to as the "shipment") will be sent to the address of the interested party within 3 working days.

When receiving the shipment, the interested party is obliged to check the shipment (number of packages, integrity of the packaging - box) to see if its contents were damaged during transportation. The interested party is entitled to refuse acceptance of a shipment that is not in accordance with the purchase contract because the shipment is, for example, incomplete or damaged. If the interested party takes over the damaged shipment from the carrier, it is necessary to describe the damage in the handover report. An incomplete or damaged shipment must be reported immediately by e-mail to the address info@easyoptic.cz and a damage report must be drawn up with the carrier and sent to the Seller by e-mail or post without undue delay. An additional complaint of incompleteness or external damage to the shipment does not prevent the interested party from complaining about the item, but it gives the Seller the opportunity to prove that this is not a violation of the purchase contract.

By signing the delivery note, the interested party confirms that the shipment of goods met all conditions and requirements and that any later claim due to damage to the packaging of the shipment cannot be taken into account.

The interested party is entitled to use the optical frames in accordance with the agreed purpose, i.e. to try them on, and is obliged to protect the optical frames from damage, loss or destruction and then return them to the Seller. There is a trial period of 4 working days for the use of the optical frames from the date of delivery of the shipment to the interested party, i.e. that the interested party undertakes to send all the optical frames back at the Seller's expense to the optical shop Easy Optic, Jugoslávská 320/21, Prague 2, 120 00, no later than the 4th working day from the date of delivery.

If the interested party has chosen from the hometrial frames, he can order them including the prescription lenses (hereinafter referred to as "eye lenses") and pay their price via the web interface (see ordering goods). If the interested party enters the code in the product order, which he received in the confirmation email of ordering the product for the hometrial, the amount of CZK 190 will be deducted from the purchase price of the eyeglasses. The ordered glasses will then be sent to him with the original case and the cleaning cloth.

If the interested party does not return the shipment within the above-mentioned period, he is obliged to pay the Seller a contractual penalty in the amount of the total displayed price of the shipment no later than the day following the last day of the return period. Payment of the contractual penalty does not affect the Seller's right to demand the return of the optical frames or payment of their price in court and to demand compensation for damage consisting mainly of a reduction in the value of the optical frames and lost profit.

If the interested party returns the shipment incomplete, damaged or destroyed, he is obliged to reimburse the Seller for the resulting damage. The Seller will notify him of the amount of damage incurred at his address without undue delay after receiving the returned shipment.

Security and Protection of Information, personal data

The seller processes the buyer's personal data in accordance with the applicable legal regulations, i.e. Act No. 110/2019 Coll., on the protection of personal data, and from 25.5.2018 also in accordance with the Regulation of the European Parliament and the EU Council No. 2016/679 on the protection natural persons in connection with the processing of personal data and on the free movement of such data (GDPR).

What personal data, for what reason and how it is processed and what are the rights of the buyer, are listed in the Privacy Policy section. By agreeing to these terms and conditions, the Purchaser declares that he has also become familiar with the Privacy Policy and agrees with it.

The primary method of communication between the Seller and the Buyer is e-mail (exclusively through the above e-mail address). If the Seller communicates with the Buyer via postal services (only through the above delivery address), the Buyer bears the costs of this communication and the Seller reserves the right to respond via e-mail in this case, if the Buyer provides his e-mail address. The Seller is entitled to communicate with the Buyer also through other communication channels (typically through social networks).


These Terms and Conditions become effective on February 22nd 2023 and replace all previous provisions and arrangements. The Seller reserves the right to change these General Terms and Conditions without previous notice.

Within the meaning of Section 1820 (1) (j) of the Civil Code and Section 14 (1) and Section 20d et seq. of Consumer Protection Act 634/1992, the consumer advises the seller that with the consumer out-of-court settlement of a consumer dispute, the consumer can turn to an out-of-court consumer disputes body, such as the Czech Trade Inspection (Česká obchodní inspekce), with the registered office at Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, internet address: www.coi.cz .  
Further it is possible to use the online dispute resolution platform at http://ec.europa.eu/consumers/odr. No provision of this conditions does exclude the right of the consumer to file a lawsuit by the respective court.
